Your situation

Selling during probate, without the listing circus

When a loved one passes away, the house often cannot be sold the usual way until the estate moves through probate in a Alabama court. Meanwhile the property still needs insurance, tax payments, yard care, and someone watching over it. Listing with an agent on top of that — cleanouts, repairs, showings, and a buyer whose financing can fall through — is more than most families want to carry.

Wise Revival, founded by Alberto Molina and Kyle Sowell, buys houses in probate for cash, as-is, anywhere in Alabama. We can make an offer early and close once the estate has the authority to sell, on a timeline that fits the court process — not the other way around.

How we handle it

How Wise Revival handles a probate sale

Start with a conversation. Tell us where the estate stands: whether a will exists, whether an executor or administrator has been appointed, and what the court timeline looks like. We give you a fair cash offer within 24 hours so the estate knows the real number, and we are patient — if closing has to wait for the court, the offer process still costs you nothing and creates no obligation.

We buy the house exactly as it sits. The estate does not need to repair, clean, or empty it, and there are no agent commissions or fees from us eating into what the heirs receive. One clean closing, and the estate can distribute the proceeds instead of managing a property.

Situations we see every week

We buy in situations like yours

Executor or administrator selling

If you have been appointed to handle the estate, we keep the sale simple, documented, and on your timeline.

Probate court administration

Many Alabama estates move through administration in probate court, which can make selling more straightforward once the personal representative has authority to sign.

Heirs who live far away

The whole sale can be handled remotely — no repeated trips back to Alabama.

House sitting empty

An empty house still costs money every month. Cash closes the chapter faster.

Property needs major work

Estates rarely want to fund a renovation. We buy as-is, no repairs needed.

Multiple heirs receiving proceeds

A single clean cash sale is often simpler to divide than a property everyone co-owns.

Alabama information

How probate sales generally work in Alabama

In Alabama, estates are administered under the Alabama Probate Code (Ala. Code Title 43) in the probate court of the county where the owner lived — Alabama probate courts are run by the county's judge of probate. The court opens the estate and issues Letters Testamentary (where there is a will) or Letters of Administration (where there is not) to the personal representative, which is the document that authorizes that person to act for the estate — gather assets, give notice to creditors, and deal with estate real estate. In most cases a personal representative needs a court order to sell estate real estate, and the sale follows the probate court's procedures. Selling to a cash buyer does not skip probate: title has to be clear before any buyer can close.

Alabama also has a simplified route for qualifying small estates — summary distribution (Ala. Code § 43-2-692) — where the estate is small enough and the statutory conditions are met, the probate court can order the assets distributed without a full administration. Summary distribution covers personal property only, so it cannot by itself transfer a house — an estate that includes a house needs the regular administration. Creditors' claims and the estate's debts still have to be handled under the Code's deadlines either way. A probate attorney in the county — or the probate judge's office — can confirm what your estate needs.

Important note: The information on this page is general information about Alabama law and the foreclosure process. It is not legal advice, and it is not a substitute for advice about your specific situation. Wise Revival is a home-buying company, not a law firm, and no one at Wise Revival is your lawyer or your real estate agent. Laws and timelines change, and lenders and courts handle cases differently. If you are behind on your mortgage or in foreclosure, talk to an Alabama attorney, contact your mortgage servicer, or speak with a HUD-approved housing counselor — that help is free — before you sign anything, including with us.

Good to know

Common questions

Who is allowed to sell a house in probate?

Generally, the executor named in the will or the court-appointed administrator is the person with authority to sell estate property, once the court has granted that authority. The details depend on the estate — a Alabama probate attorney can confirm who can sign.

Can we get an offer before probate is finished?

Yes. We can review the property and make a fair cash offer while the estate is still in process, then close once the authority to sell is in place. There is no cost or obligation.

Does the house need to be cleaned out or repaired for probate?

Not to sell to us. We buy as-is and handle the cleanout after closing, so the estate does not spend money getting the house market-ready.

How long does a probate sale take with a cash buyer?

The court process sets the pace, not the buyer. Once the estate can legally sell, we can close in as little as 7 days — or on a later date you choose.

Are there fees or commissions?

No. We charge no fees and no commissions, and the offer we make is the offer we honor at closing — no renegotiation.
